Scope and definitions

These Terms apply to the hosted service available at globatics.live. The self-hostable version of the software is governed by the license in its repository, not by these Terms.

  • Customer: the person who creates an account and, where applicable, subscribes to a plan.
  • Customer site: a website or app on which the Customer installs the Globatics tracker.
  • Visitor: a person who visits a Customer site.
  • Audience data: the data collected on Customer sites and processed on the Customer’s behalf.
  • Plan: the free plan (Free) or one of the paid plans (Starter, Pro, Business) described on the Pricing page.
  • Event: a pageview or a custom event recorded for a Customer site; it is the unit of the quotas.

The service

Globatics measures the audience of Customer sites and shows it live and in reports: live globe, reports, goals and funnels, alerts, API, MCP server, exports and analysis assistant. Features evolve; notable changes are published in the changelog. Features marked “beta” are provided as is. Changelog.

Who the service is for

The service is intended for professionals (companies, freelancers, non-profits, site publishers) acting for the purposes of their business. A person who subscribes as a consumer also benefits from the protective provisions of the French Consumer Code set out in these Terms (withdrawal, renewal, conformity, mediation).

Account

  • Provide an e-mail address you control and accurate information.
  • Keep your password, two-factor codes and API keys secret: actions taken with them are attributed to you. Tell us without delay about any unauthorized use.
  • You can delete your account at any time from the Account page.

Acceptable use

  • Only measure sites you publish or are authorized to measure.
  • Don’t send unnecessary or sensitive data in events, properties or identify() traits: passwords, payment data, health data or any special category under GDPR article 9.
  • Don’t use Globatics to follow people across sites, fingerprint them or profile them for advertising.
  • Don’t overload, probe or attack the service, or circumvent its limits or security measures.

Your obligations towards your visitors

For Audience data, the Customer is the controller and Penra its processor. The Customer undertakes to:

  • inform its Visitors of audience measurement in its privacy policy (a ready-to-copy paragraph is provided in Settings → Tracking and in the GDPR & CNIL guide);
  • have a legal basis for every processing it configures;
  • if it relies on the CNIL’s consent exemption for audience measurement, meet its conditions: purpose limited to measuring its own site’s audience, anonymous statistics, no cross-referencing with other processing, no transfer of non-anonymous data to third parties;
  • collect its Visitors’ prior consent when it enables features outside that scope, in particular identify(), data-persist or visitor profiles linked to its own user ids, and honour refusals and withdrawals.

Plans, limits and prices

The service comes as a free plan with no time limit (Free) and three paid plans (Starter, Pro and Business), billed monthly or yearly. For each Plan, the included features, the limits (Events per month, number of sites, history depth, replay window, assistant questions, goals, funnels, alert rules) and the prices are those shown on the Pricing page in its version in force on the day of subscription, which forms part of these Terms.

Prices are in euros excluding tax; applicable VAT is added at checkout, and the price including all taxes is shown before any order is confirmed. The live globe, the live feed and the core reports remain available on the free plan.

Free trial

  • Every new account gets the Pro plan for 14 days, once per Customer, without providing any payment method.
  • The trial never turns into a paid subscription: nothing is charged when it ends. The account moves to the free plan automatically, unless the Customer has subscribed to a paid plan in the meantime.
  • When the trial ends, the data collected is kept; only the features and history not included in the free plan stop being accessible, until the Customer subscribes.
  • Creating several accounts to chain trials is abusive use (see “Suspension”).

Quotas and fair use

The Event quota applies to the account, all its sites together, per calendar month (UTC). Filtered bots and test visits are not counted.

  • at 80% of the quota, the Customer is warned in the app;
  • at 100%, the Customer gets a notification; collection continues;
  • beyond 150%, new Events from the account’s sites are refused until the next month starts or until the Customer subscribes to a higher plan. Dashboards, history and the exports included in the Plan stay available.

Overage is never charged. Reports show the history included in the Plan; older data is not deleted because of a plan change and becomes visible again after an upgrade, within the retention period set for each site. Creating items beyond the Plan’s limits (sites, goals, funnels, alert rules) is refused. The API, the MCP server and the assistant must be used reasonably: if abnormal use threatens the stability of the service, we contact the Customer before taking any measure, except in an emergency.

Ordering and payment

Subscriptions and the Founders licence are sold and collected by Polar Software Inc., acting as reseller (“Merchant of Record”): Polar issues the invoice, collects and remits the applicable VAT or sales tax, and its buyer terms apply to the payment. Card details are processed by Polar and its payment providers; they are never sent to Penra.

Subscriptions are paid in advance, at the start of each monthly or yearly period. If a payment fails, Polar retries it; the Plan stays active during that time, then the account returns to the free plan if the payment does not go through.

Changing plans

  • An upgrade takes effect immediately. Polar prorates it: the Customer only pays the difference for the rest of the current period.
  • A downgrade, or a switch between monthly and yearly billing, is handled by Polar under the same proration rules, any credit being applied to later invoices. Features and history not included in the new Plan stop being accessible; data is not deleted.

Term, renewal and cancellation

  • Monthly or yearly subscriptions renew automatically for the same period until cancelled.
  • You can cancel at any time, in a few clicks, from the billing page of the app or the Polar customer portal; cancellation takes effect at the end of the current period and the account returns to the free plan.
  • Unless the law or the money-back guarantee below says otherwise, a period that has started is not refunded. The Founders licence is not a subscription: it does not renew and needs no cancellation.
  • Consumers: for a yearly subscription, we tell you by e-mail, no earlier than three months and no later than one month before it ends, that you may choose not to renew it (French Consumer Code L. 215-1).

30-day money-back guarantee

A Customer who is not satisfied can ask, within 30 days of their first payment for a paid plan or for the Founders licence, for a full refund of that payment, without giving a reason, by writing to contact@globatics.live. Polar refunds it to the original payment method; the subscription or licence ends and the account returns to the free plan. This guarantee applies once per Customer and comes on top of the consumer right of withdrawal, which it does not limit.

Founders licence

  • The Founders licence gives access, for a single payment of €299 excluding tax, to the features and limits of the Pro plan for the life of the service. It is personal, tied to one account, non-transferable, and limited to one per Customer.
  • “Life of the service” means: for as long as Penra or its successor runs the hosted Globatics service. Should the service end, holders would be told at least 90 days in advance and could export all their data; the self-hostable version stays available free of charge.
  • If the limits of the Pro plan are ever reduced, a licence already bought keeps at least those of the day it was bought. The quota and fair-use rules apply as for a subscription.
  • The number of licences is capped at 100 in total. Once the cap is reached, the offer is closed and is not offered again under another name.

Right of withdrawal (consumers)

Consumers have 14 days from subscribing to withdraw, without giving a reason (French Consumer Code L. 221-18). The subscription only starts before that period ends if the consumer expressly asks for it when ordering. If they then withdraw, they owe an amount for the service provided until they communicated their decision, in proportion to the total price (L. 221-25); the rest is refunded within 14 days.

To withdraw, send an unambiguous statement to contact@globatics.live, for example:

Model withdrawal form

(Complete and return this form only if you wish to withdraw from the contract.) “To Penra, contact@globatics.live: I hereby give notice that I withdraw from my contract for the provision of the following service (Globatics subscription). Ordered on: … — Name of consumer: … — Address of consumer: … — Account e-mail: … — Signature of consumer (only if this form is notified on paper): … — Date: …”

Availability and support

Penra uses reasonable efforts to keep the service available and fast (best-efforts obligation), without guaranteeing it will never be interrupted. Maintenance may occur, outside peak hours where possible. No service level is committed unless agreed separately in writing. Support is by e-mail at contact@globatics.live.

Liability

Statistics are measurements: ad blockers, bots, networks and browser settings make them approximate, and they must not be the sole basis for billing anyone.

Towards professionals, Penra is not liable for indirect damage (lost revenue, data, reputation or opportunity), and its total liability is capped at the amounts paid by the Customer for the service in the 12 months before the event giving rise to the claim. These limits do not apply to gross negligence or wilful misconduct, or to personal injury.

Consumers benefit from the statutory conformity guarantee for digital services (French Consumer Code L. 224-25-12 and following), which no clause limits.

Intellectual property

Penra keeps all rights in the service, its software, brand and content; the Customer receives a personal, non-exclusive right of use for the term of the contract. The Customer keeps ownership of its data and of the Audience data, and only grants us the right to process them to provide the service.

Personal data and processing

Account data is processed as described in the privacy policy. The data processing agreement (GDPR article 28) is part of these Terms: by accepting them, the Customer accepts it for Audience data.

Suspension and termination by Globatics

In case of serious breach (unlawful use, threat to the security of the service or of others, non-payment), Penra may suspend access after informing the Customer, or immediately in an emergency. If the breach is not remedied 30 days after notice, the contract may be terminated. The Customer can export its data during that period; it is deleted afterwards.

Data at the end of the contract

The exports included in the Customer’s Plan (CSV reports from Starter, raw JSONL events on Business) and the account data export remain available while the account exists. Whatever the Plan, the Customer gets a full export of its Audience data on request before deleting a site or the account, or at the end of the contract. Deleting a site or the account immediately erases the corresponding data from the production database; technical backups are overwritten within 30 days.

Changes to these Terms

We tell Customers by e-mail or in the app at least 30 days before a significant change takes effect. A Customer who refuses it can cancel before that date; running subscriptions keep their agreed price until the end of the period. Version 2026-10-24 introduces paid plans, the trial, the Founders licence and quotas: Customers who signed up before it are told by e-mail and in the app, and it applies to them 30 days after being told, or sooner if they subscribe to a plan.

Governing law and disputes

These Terms are governed by French law. Write to us first at contact@globatics.live: we look for an amicable solution. Failing that, disputes between professionals fall under the competent courts of the place of Penra’s registered office. Consumers may choose the court of the place where they lived when the contract was concluded or when the harmful event occurred (French Consumer Code R. 631-3).

Consumer mediation: after a written complaint that remained unresolved, consumers can refer the dispute free of charge to a consumer mediator (French Consumer Code L. 612-1).
